Premium Processing Resumed for H1Bs
U.S. Citizenship and Immigration Services (USCIS) announced late on 9/18/2017 that they resumed premium processing for all H-1B visa petitions subject to the Fiscal Year year (FY) 2018 cap. Premium Processing was originally suspended in late March for all FY 2018 cap H1B cases. Limited types of H1Bs had already resumed eligibility to premium process. Premium Processing requires submission of an additional form and payment of a $1225 additional filing fee. Premium Processing guarantees a response (note that this is not always a decision) within 15 days. Consideration of whether an "upgrade" to the premium processing queue is beneficial is especially important for many foreign students whose work permits will be expiring on 9/30/2017 and will otherwise face a leave of absence pending the H-1B approval.
